Texas v. M.H. — Motion to Suppress Granted; Felony Possession of a Controlled Substance and DWI (Oct. 2023)

Client left a bar and began driving home. The bar was a known hangout for certain outlaw motorcycle club members, unaffiliated with Client; however, Undercover police officers followed Client after he left the bar for several minutes before pulling him over for his plates not returning. At the suppression hearing, the testifying officer admitted they could have run the wrong plate number, and that he had no other reason to pull Client over. The judge suppressed all evidence after the stop: a felony quantity of a controlled substance, all intoxication evidence, and the 0.15 blood test.
